Through the handling of many dissolution of marriage and related cases, we have come to the conclusion that our clients would appreciate a brief explanation of the family law procedures in California and our own policies. This is not a substitute for direct explanations you may receive in our office, but as a supplement.
Dissolution of Marriage / Divorce
Pre-Marital/Pre-Nuptial Agreements:
Before a couple marries, the parties may wish to create a legal agreement stating what shall take place should the marriage dissolve. When creating this agreement, both parties will need to seek counsel so that their individual interests are equally protected.
Post-Marital/Post-Nuptial Agreements:
Similar to a Pre-Marital or Pre-Nuptial Agreement, however this agreement is created after the couple is already legally married.
Legal Separation:
When a couple is not yet ready to seek a divorce, but is also no longer interested in living together as a couple, they may seek a Legal Separation.
Child Custody:
Once a couple separates, they must come to an agreement regarding the percentage of time that each parent will have the children. Some options are Sole Custody, Joint Custody, 50/50 Custody, and Physical Custody.
Spousal Support:
Sometimes after a marriage dissolves, one of the parties is entitled to financial support from the other party.
Child Support:
Sometimes after a marriage dissolves, one party will be held responsible for paying support to the other party in order to pay for expenses incurred by the children.
Visitation:
The time spent between one parent and the children.
Modification:
When someone desires to change or alter a pre-existing court order or agreement, they can seek a modification, which will legally change the current agreement that they have. One can seek to modify custody, support, and visitation.
